Opening a Business Process

1. Research the Property

  • Zoning: Ensure the property’s zoning allows for a restaurant. Factors like customer parking and existing building use depend on the adopted zoning ordinance. Contact the relevant municipality before signing a contract:

  • Water & Sewer: Confirm if public water and sewer systems can meet your needs. Contact the Washington Suburban Sanitary Commission (WSSC) at 301-206-4001. If using a private well or septic system, check with DPS Well & Septic at 240-777-0311 for any restrictions.

2. Hire a Professional

  • If modifying a space or obtaining a use and occupancy permit, a commercial building permit is required. Submit plans signed by a licensed Maryland design professional.
  • Schedule a free predesign consultation with DPS experts to clarify code requirements, drawings, permits, and licenses.

4. Submit Permit Applications, Fees, and Drawings

  • Depending on the scope of work, multiple permits may be needed. Submit plans, including those required by DHHS, using DPS eServices.
  • Construction drawings must be signed by a licensed Maryland design professional.

5. Contact DHHS for Restaurant-Specific Licenses

  • All restaurants require a Food Service Facility license from DHHS, renewed annually. Submit the license application within 30 days of DHHS inspections. The restaurant must have a Certified Food Service Manager present at all times.

6. Schedule Inspections

  • Schedule required inspections online. Inspections by DPS and DHHS must be successfully completed before opening.

  • Alcohol License: To serve or sell alcohol, apply through the Department of Alcohol and Beverage Services (ABS). Restrictions may apply in some areas. Visit the ABS website for details.
